1. Introduction and Acceptance
Welcome to OpenBulu (the "Platform", "we", "us"). The Service is operated and provided by OpenBulu, an independently operated AI service brand.
These Terms of Service (these "Terms") govern your access to and use of the AI model access gateway service (the "Service") that we provide at https://openbulu.com.
By creating an account, purchasing prepaid credits, or otherwise using the Service, you confirm that: (a) you are at least 18 years old; (b) you have read, understood and agree to be bound by these Terms; (c) you agree to our Privacy Policy; and (d) you have authority to enter into this agreement on behalf of yourself or the organisation you represent.
⚠️ Important: If you do not agree to these Terms, do not use the Service. Continued use after an update constitutes acceptance of the revised Terms.
2. Description of the Service
2.1 What We Provide
OpenBulu provides an AI service platform that enables users to call multiple third-party artificial intelligence models through a unified interface, together with key management, usage metering, log auditing and billing. The Service is a digital Software-as-a-Service (SaaS) product delivered over the internet.
2.2 Nature of the Service
The Service is an intangible digital product. Access is enabled once payment is confirmed. Because delivery is immediate and digital, refunds are subject to the specific limitations set out in Section 7.
2.3 Dependence on AI Models
The Service uses AI models through third-party AI model providers (model aggregation and routing services). The performance and availability of the Service may be affected by the operational status of those providers and of the underlying model suppliers. We will use reasonable efforts to notify you promptly of material outages.
3. Account Registration and Eligibility
3.1 Account Creation
Use of the Service requires an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3.2 Account Security
Notify us immediately at support@openbulu.com if you become aware of any unauthorised use;
Do not share your credentials with any third party;
Keep your billing email address up to date.
3.3 Business Accounts
If you register on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
4. Prepaid Credits and Top-up Plans
The Service operates on prepaid credits. You may purchase credit packages at any time; credits are used to access the features of the Service. Current top-up plans and pricing are available at https://openbulu.com/pricing.
5. Billing and Payment
5.1 One-time Purchase Authorisation
Each purchase is a one-off transaction. Completing a purchase authorises OpenBulu to charge your payment method for the amount displayed at checkout.
5.2 Taxes
Unless stated otherwise, prices displayed do not include applicable taxes. Where required by applicable law, such taxes will be collected at checkout.
6. Credit Validity and Account Termination
6.1 Credit Validity
Purchased credits remain valid indefinitely from the date of purchase and have no expiry date. If an expiry period is introduced in the future, we will state it clearly before purchase and send you a reminder before expiry.
6.2 Account Termination
If your account is terminated (whether by you or by us), unused credits are retained for 30 days after termination. After that period unused credits lapse and are non-refundable, except where applicable law requires otherwise.
7. Refund Policy
Consumed credits are non-refundable in principle. The following exceptions apply:
Unused within 7 days: a full refund may be requested if credits have not been used within 7 days of purchase;
Duplicate charges: any billing error is refunded in full;
Statutory rights: the above does not limit non-waivable statutory rights that you have under consumer protection law in your country or region. The Platform does not currently provide services to European Union member states or the United Kingdom, so the EU / UK statutory right of withdrawal does not apply to this Service.
To request a refund, contact us at support@openbulu.com with your account email address and transaction ID.
8. Billing Disputes
If you believe a charge is incorrect, please contact us at support@openbulu.com before raising a dispute with your bank. We undertake to respond within 2 business days and to resolve confirmed billing errors within 5 business days.
9. AI Output and Intellectual Property
9.1 Ownership of Output
Subject to these Terms, AI content generated from your inputs ("Output") belongs to you. You may use Output for any lawful purpose within the limits of Section 10.
9.2 Licence Over Inputs
By submitting content to the Service ("Input"), you grant OpenBulu a limited, non-exclusive licence to process your Input solely for the purpose of delivering the Service. We will not use your Input to train AI models without your explicit consent.
9.3 Third-Party AI Model Dependence
The Service uses third-party AI model providers and the underlying model suppliers they route to. Output may be affected by those providers' models. We do not guarantee any particular output quality and accept no responsibility for content generated by third-party models.
9.4 Accuracy of AI Output
AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it.
10. Acceptable Use Policy
10.1 Permitted Use
You may use the Service only for lawful purposes permitted by these Terms. The complete acceptable use rules are set out in "Appendix A: Acceptable Use Policy (AUP)" to these Terms. That Appendix forms an integral part of these Terms and has the same legal effect as the main body of these Terms.
10.2 Prohibited Use
You agree not to use the Service to:
generate unlawful, defamatory, harassing or fraudulent content;
generate, distribute or assist in producing deepfake content — including AI-synthesised audio, video or images — that impersonates a real person, or that is intended to deceive viewers as to its origin or authenticity;
generate content that sexualises minors or violates child protection laws;
create malware, phishing content or network attack tools;
infringe the intellectual property or privacy rights of any third party;
circumvent or interfere with the security features of the Service;
resell or sublicense access to the Service without prior written approval;
violate any applicable law, regulation or card network rule.
10.3 AI-Specific Prohibitions
Given the AI nature of the Service, you specifically agree not to:
use the inputs, outputs, model responses or any derivatives of the Service to train, fine-tune, benchmark, distil or otherwise develop any artificial intelligence or machine learning model that competes, directly or indirectly, with OpenBulu products or the Service;
systematically scrape, extract or bulk-collect model outputs for purposes beyond your authorised use of the Service;
present AI-generated output as the work of a human professional (such as a practising physician, lawyer or financial adviser) in contexts where it may cause harm.
11. Data, Privacy and Security
Your use of the Service is governed by our Privacy Policy, published at https://openbulu.com/privacy-policy. Payment card data is handled by our PCI-DSS compliant payment processor (Waffo Pancake) and is not stored on our servers. Account data is retained for 90 days after deletion and then removed.
12. Disclaimers and Limitation of Liability
12.1 Disclaimer
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of AI output.
12.2 AI-Generated Content Disclaimer
⚠️ AI-Generated Content Disclaimer Output may be inaccurate, incomplete or out of date. Do not use it for legal, medical, financial or other professional advice. Always verify AI-generated content with an appropriately qualified professional before acting on it.
12.3 Limitation of Liability
To the maximum extent permitted by applicable law, OpenBulu is not liable for any indirect, incidental, consequential or punitive damages. Our aggregate liability shall not exceed the amount you paid to the Platform in the 12 months preceding the event giving rise to the claim.
13. Term and Termination
These Terms remain in effect while you use the Service. We may suspend or terminate your account if you materially breach these Terms, if we suspect fraudulent activity, or where required by law. If we terminate the Service for reasons other than your breach, we will refund any unused prepaid credits in full. You may delete your account at any time by contacting support@openbulu.com.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict of laws rules. Any dispute arising out of these Terms is subject to the jurisdiction of the courts of the Hong Kong SAR. Before commencing any formal proceedings, please contact us at privacy@openbulu.com to seek a coordinated resolution.
15. General
We may update these Terms at any time. Material changes will be notified by email at least 15 days before they take effect. Continued use constitutes acceptance. If any provision is held to be unenforceable, the remaining provisions remain in full force and effect.
Language: The English version of these Terms governs. Translations into other languages are provided for convenience only; in the event of any inconsistency between a translation and the English version, the English version prevails.

Appendix A: Acceptable Use Policy (AUP)
OpenBulu (the "Platform", "we") is committed to providing safe, lawful and responsible AI-generated content services. This Acceptable Use Policy (this "Policy") applies to all content generated, published, distributed or stored through the Platform, and sets out the Platform's content standards, moderation mechanisms, reporting process and enforcement measures. All users, developers and merchants using the Platform must comply with this Policy. This Appendix forms an integral part of the Terms and has the same legal effect as the main body of the Terms.
A.1 Scope
This Policy applies to all content types processed through the Service, including:
Text: AI-generated text, conversations, code, articles and similar;
User input (prompts): prompts and instructions submitted by users.
"Generated content" as used in this Policy has the same meaning as "Output" as defined in Section 9.1 of the main Terms.
The Platform is a text-only AI gateway and does not provide image, audio or video generation capabilities.
A.2 Content Standards and Prohibited Categories
The Platform applies graded controls to the following six categories of content; specific prohibitions and exceptions are set out in A.2.1–A.2.3:
Pornographic / NSFW content;
Violent / gore content;
Hate speech;
Child-unsafe content (CSAM);
Deepfakes / impersonation of real persons;
Copyright- or trademark-infringing content.
The following provisions further elaborate the categories above and other violations.
A.2.1 Absolute Prohibition — Zero Tolerance
The following content is actioned immediately upon detection and may be reported to the competent authorities:
Child sexual exploitation material (CSAM) or any sexual content involving minors;
Content that promotes or assists terrorism, extremism or mass violence;
Technical instructions for weapons of mass destruction;
Content inciting genocide or ethnic hatred;
Non-consensual deepfake sexual content targeting real individuals.
A.2.2 Restricted — Subject to Review
Adult sexual content: not permitted in principle; any exception requires separate prior approval from the Platform and must satisfy applicable age verification and local legal requirements;
Violent content: must have a clear creative or educational context;
Politically sensitive content: must not be used to generate or spread misleading disinformation;
Medical / legal / financial advice: must comply with local regulatory requirements.
A.2.3 Generally Prohibited Conduct
Generating or spreading disinformation or debunked claims;
Impersonating real individuals, brands or institutions;
Infringing intellectual property, portrait rights or privacy rights;
Passing off AI-generated content as human-authored in order to deceive users;
Bulk generation of spam or deceptive commercial content;
Jailbreak prompts intended to bypass the Platform's safety measures.
A.3 Content Moderation
The Platform operates a multi-layered moderation system of "automated review + human review + periodic sampling".
A.3.1 Automated Moderation (Real-time)
All requests and generated content are scanned by safety filters in real time.
Input filtering: keyword, semantic and intent detection applied to prompts;
Output filtering: real-time safety assessment of output;
Usage pattern analysis: monitoring of anomalous API call behaviour;
Moderation model used: OpenAI Moderation API.
A.3.2 Human Review
Content flagged automatically enters a human review queue;
Content reported by users is manually reviewed by the trust and safety team;
Operating schedule: the automated moderation layer runs 24/7 in real time; human review is conducted 09:00–18:00 (GMT+8) on business days. The "first response" timeframes listed in A.6 are met immediately by the automated moderation layer;
Reviewers must complete content safety training and sign confidentiality agreements.
A.3.3 Periodic Sampling
Random sampling review frequency: monthly;
Periodic evaluation and improvement of classifier accuracy;
Independent third-party audit: whether to introduce one is assessed periodically based on business scale and risk profile.

A.4 Reporting
A.4.1 What to Report
Content or conduct that violates the content standards of this Policy;
Serious violations involving child safety or terrorism;
AI impersonation of another person or infringement of your own rights;
Other circumstances that the Platform considers should be reported.
A.4.2 Reporting Principles
Confidentiality: the identity of the reporter is strictly protected;
Impartiality: every report receives an independent and objective review;
Anti-abuse: malicious or false reports are logged and actioned.
If additional time is needed, we will proactively notify the reporter and explain the reason. Process: receipt (automatic acknowledgement) → triage (L1–L4 grading) → review (automated + human) → decision → action → notification.

Content safety transparency report: published annually, disclosing the number of reports received, enforcement outcomes and improvements to moderation mechanisms during the period;

Continued use of the Platform constitutes acceptance of updates.
